I saw Kristin Candy’s documentary “Farmageddon” last Friday, when it opened in Boston (including having the privilege of introducing the producer to the film audience). Even though I knew about all the cases of hit-upon farmers and food clubs, a few pictures are sometimes worth a few thousand words, and in that vein, two scenes stick most vividly in my mind.
The first is the video of Georgia consumers pouring out in a farm field the raw milk they had already purchased, under the watchful eyes of agents from the U.S. Food and Drug Administration and the Georgia Department of Agriculture. Even though I’ve seen the photos and video before, seeing the dozens of consumers meekly acquiesce to the orders to dispose of their good food was still upsetting to me–a totally humiliating experience for the victims.
The second haunting scene is one of police and agents from the FDA and Pennsylvania Department of Agriculture raiding Mennonite farmer Mark Nolt’s farm in 2008. It was one of three raids he endured.
At one point during the raid, a policeman tells Nolt, while both are standing on the porch of his farm store, that he can’t go inside while the agents are searching and confiscating food and equipment. Nolt walks past him into the store, and the cop does nothing. The action was symbolic of Nolt’s entire approach to the PDA’s campaign against him.
After raiding Nolt’s farm three times, the PDA gave up on Nolt. My guess is that the case against him, for giving up his PDA raw milk permit and instead selling privately, had become so complicated and convoluted that even the regulators could no longer figure it out.
I have to admit that at one point while it was happening I became very frustrated with Nolt’s passivity in dealing with the authorities. Why didn’t ‘t he just try to resolve the situation, I wondered.
Well, now having seen other farmers like Vernon Hershberger in Wisconsin and Brigitte Ruthman in Massachusetts, and Michael Schmidt in Canada, along with the food club group in Kentucky, having defied orders, I realize that they have it right.
Yes, they had to pay heavy dues by enduring the threats and pressure and even the invasion of their homes, but in the end, they have won. I can appreciate that Mark McAfee is frustrated that some California dairy farmers are wary of joining in discussions with the California Department of Food and Agriculture over herdshare rules. It may be we don’t want unanimity. The authorities need to know there are growing numbers of people out there very suspicious of official motives and totally fed up with the clampdowns, ostensibly in the interests of “food safety,” even when there is no safety problem.
The reality is that the authorities are more afraid than we realize, and with good reason. They don’t want to risk alienating local residents, prosecutors, and law enforcement to such an extent that they have widespread resistance on their hands from one or another of these parties.
So they will no doubt continue their practice of trying to intimidate by going after one or another farmer or food club. It seems ever clearer that the best strategy is non-cooperation, or even resistance. We have enough heroes now who have taken that route, and we know it works. It’s a strategy not without costs, but then, whoever said freedom came cheaply? Indeed, it might be said that we are fighting a guerilla war, which means that everyone contributes to the common goal in his or her own best way.
And we know people are catching on to the notion of food freedom. All the private home restaurants springing up, even travelers smuggling in soft cheeses aged less than 60 days from Europe.
All this in light of fast-accumulating evidence that raw milk and related foods significantly improve health.
By the way, “Farmageddon” will definitely get you thinking, and isn’t that the best sign of a good movie? (Upcoming showings will be taking place in San Francisco and Hartford, CT.)
There is a huge email side bar discussion that is raging right now. The question is whether this is a Food Freedom Fight or is this a Food Safety Fight.
Both sides have created very good arguments that show deep thought development, and committment. I am committed to the concept that raw milk will advance if it is safe and more and more people consume it….all about change by market development.
The Freedom Fighters are committed to liberation by rebellion and demanding Freedom. A freedom that has been denied to them where ever they live in America.
I support these fighters. I am one of them.
But…my reality has been developed over 12 years of fighting and being beaten up and mostly losing. I concluded that the best way forward was to comply with the oppressive regs….what ever it takes, so that I could prove raw milks safety. To build a track record that was so strong that it could not be denied.
Then,…we could change the laws and have true freedom. Freedom fighting early on…. without a simpathetic base of huge consumer support would be relegated to being just a fringe movement not taken seriously by anyone.
So is this about Freedom or about Food Safety?
When you get raided you will say to yourself….we should have used a food safety plan to deny the FDA the grounds to shut me down, as your so called Freedoms are being crushed. There seems to be a reality problem….people just do not understand that our grand parents made a Faustian Deal with the Devil 70 years ago. They traded freedom for regulations. Now we realize that the deal sold our health in the trade.
How do we undo the deal….yes….it is freedom figting, but it must be also be very smart with Food Safety Plans to assure no errors as we move this educational, economic, regulatory and political mountain. If we do not, we will undo all of our work and egg on our faces at he most inopportune time. This is preventive caution.
Pure Freedom fighting reminds me of the pilots that " kick the tires and light the fires". They are the pilots that crash. The pilots that cautiously use checklists, call for weather, work hard to sharpen skills and think about risks….they are the pilots that live long healthy lives. safety is work. Nothing romantic about it. Hard work and a committment to never miss a beat.
If raw milk is going to emerge and gain respect in this brave world of personal responsibility, planned success and hard work will lead the path to Freedom.
Outbreaks will forever enslave us if we are not committed to breaking these shackles. We have the tools. Freedom fighting is just a part of being liberated.
Capitulating to the powers that be is no guarantee of success. We've seen this over an over again. What is being shown to work is the Hershberger model…those that show REAL backbone in standing up for what is right. Finding different ways to fellate those that occupy governmental regulatory bodies, the ones who revolve in and out of Big Ag…might be admirable work for some…but many out here don't trust their government, and would rather not enter into a contract with an entity which has shown it's untrustworthiness time and time again.
Private and personal contract (and contact)…between farmer and consumer….is what the real raw milk movement is all about. Orgasming about how many thousands of gallons you can ship to the chain grocery store shelves is a perversion of this movement. Blind, faceless, throw it in a case, truck it miles from the pasture and let some minimum wage stock boy unload it onto the shelf is not the future of raw milk that most want to see.
Those brave and smart farm share owners in Ca, the ones who know better than to listen to the pied piper try and lure them out of their cover, see a better future for raw milk. 'Expose yourself or we'll come and get you' is the trumpet call of the state sanctioned raw milk opponents….to have one of our own blowing the same tune out his "horn' is disgusting.
Our raw milk future……State Sanctioned?….Third Party Sanctioned?….. or Consumer Sanctioned? The choice is ours to make.
One way or another the raw milk must flow…even if it means that farmers must go to jail.

His/the govt definition of "healthful" is different than mine. The fruit and vegetables, some whole grains I can agree with….what is their "unhealthy" fat? The body needs fat to absorb many nutrients and I wouldn't touch adulterated dairy, salt is required by the body, as for sugar, moderation.

Modern commoditization by big business and big government of not only food but of most every product and service, and more important, of money, labor, and even ideas, is the ultimate expression of power. I cannot think of a single aspect of modern life that is not touched in whole or part by centralized systems.
We are told not to worry, that having ever fewer people control ever more is simply efficient, and that centralized systems are the engines of wealth, opportunity, and happiness. But if that were true, why then is it becoming ever harder to exercise basic human rights? Why is the middle class shrinking and the gap between rich and poor widening? Why are we getting sicker? Why, as we become better educated, are we less able to care for ourselves? Why is the planet getting dirtier? Why are we becoming ever less satisfied with life?

Day 15 Hospital
(Note: the average stay in the hospital for a child diagnosed with HUS is two weeks)
Breathing on his own with just an oxygen mask became too difficult for Chris. He was becoming weak and he wasnt breathing in enough oxygen. They didnt want to intubate him again yet. They wanted to see how he would do on a BiPap machine. This breathing apparatus was awful. It has a hard, triangle shaped cup that fits over the nose and mouth like an oxygen mask, but it is sucks on the face like a vacuum cleaner attachment. If it wasnt fit correctly it would make these loud, farting type sounds. It was secured into place with this black band that had three strips that went over his head and one around his chin. The amount of suction this thing produced was unbelievable. It forced air into Chris lungs. He didnt have to take the breath himself. We had a difficult time keeping the BiPap in place. One of the respiratory therapists tied a different white bonnet like hat to keep this thing in place so that it didnt fart so often. It worked much better.
It was torture watching Chris on this machine. He was still sedated with morphine, so this helped keep him calm and asleep, but when the morphine started wearing off it was horrible. His eyes would open in a panic; he looked like a wild trapped animal. He was absolutely terrified. It is painful to even contemplate what Chris must have been thinking. Chris had to endure 3 days on the BiPap machine and we had to endure watching it.
When Chris came home from the hospital, his back had been bothering him for some time. I took him to my chiropractor. He took some x-ray and told me Chris neck was severely misaligned. Then something amazing happened. As he began to adjust the top of Chris head with the activator, he outlined the three black strips of the BiPap band. The sheer power of the suction that Chris had to endure for three days was powerful enough to disrupt the alignment of his neck.
Unbeknownst to us, this was the day CDFA recalled the products from the dairy which produced the raw milk Chris and Lauren consumed.
As I remember, I went to Loma Linda and visited with you on the second day after CDFA recalled our products….is that what you remember?

My question is this…how big is this? How effective is it? Is this a small bunch of loud passionate pissed off people or is this something else much greater? What have we triggered here??
To the revolutionaries…non-violence is crucial. They love to use their badges, guns and authoritarian macho-might to crush those that stand before them. Lots of talk about rebellion and standing against the machine. Love the romance and passion of this, but reality is different and a high cost to pay. Freedom does not actually come from this….societies require regulations. A rule of law….
Well guys we have "rule of law" in America…we just do not like the rules that are currently in charge. Why? Because we failed to show up when the regs and laws were written and passed now and 60 years ago. "We the People were a No Show!!"

At first, when I was just blooming into speak-up mode, I definitely was timid. I feared going to jail over all kinds of things as I inched my way towards courage.
But as I read more, and learned more and devoted my life increasingly to what I knew and know to be right, a beautiful thing happened: I lost my timidity.
One of the best sources of encouragement I found was a letter T Jefferson wrote about revolution and killing. Jefferson expected armed insurrections in America. He said it would very healthy for the nation to have some shooting combat between citizens and government about every 20 years.
He called that spilled blood the "natural manure" of liberty.
My point here is this: We MUST fight back against this tax-payer funded enslavement by every available means. Why do you think that the government is REALLY interested in "security"?
It isn't because they fear Mohammad Abdul Mohammad coming with an underwear bomb. It is because they are terrified that the American people will rise up in armed insurrection and take our money back.
When we de-fund their "Patriot Act" enslavement process, they will not have the means to conquer us. When we simply DEFY them, as Thoreau said regarding civil disobedience, we win.
Listen, there is nothing to fear from a little jail time for consuming raw milk in front of a cop. The whole idea is laughable, anyway. So why don't we organize a milk protest, take our gallon of raw milk to the local courthouses, and stand on the steps drinking it?
Let them arrest us. Who cares??? Force them to either back down or prove their tyranny. Can't you see it: "1,000 milk drinkers arrested for drinking fresh milk in defiance of the law".
I'm up for it. In fact, I love this idea and will promote it on my site and on facebook. We have to act, because brave men were killed establishing this country so we could be free from the tyranny of a king, and now we have a dictatorship forming right in front of us.
Just who the hell does this government think it is, denying a free people the liberty to choose for themselves?

It's important in this discussion to distinguish between "rule of law" and rule by regulators. In a number of the situations that have people especially upset, there is no law, only the interpretation of the regulators as to what they think the law allows or should allow. This is certainly the case in California and Massachusetts. Neither state has any law covering herdshare arrangements. As I understand it, the absence of a prohibition means there is no prohibition, until the legislature acts or a judge intervenes. So your fight in California is with the CA Dept of Food and Agriculture, along with a district attorney who has chosen to accept the CDFA's interpretation that herdshares shouldn't be allowed. For farmers to continue offering herdshares isn't really civil disobedience in the sense they are disobeying the law, it is merely defiance of regulators' decisions in the absence of law. The exercise you are going through with CDFA to negotiate rules for herdshares is an exercise geared toward gaining voluntary rules everyone feels comfortable with, so as to avoid the discomfort and uncertainty of going to court. But once again, there is no law behind whatever you come up with.
In Wisconsin, we have seen a judge provide a very narrow and rigid interpretation of state law. That decision is under appeal. In the meantime, Wisconsin is stuck with a vague and complex law regarding raw milk that has confused regulators and farmers alike for many years.
We have a similar situation with regard to the FDA regulation prohibiting interstate sales of raw milk. That regulation was adopted under order of a federal judge. But there is serious question as to whether it applies to interstate private contract sales of raw milk. That issue may well come up in the Rawesome and Allgyer cases. And the constitutionality of the interstate prohibition is being challenged in a suit by the Farm-to-Consumer Legal Defense Fund representing half a dozen plaintiffs.
Guess what I'm saying is that we should be careful not to immediately accept the interpretation of CDFA, MA Dept of Agricultural Resources, WI DATCP, or FDA as to whether particular actions covering access to raw dairy are legal or illegal.

It all sounds very familiar. I guess we cant complain that the FDA lacks consistency when it comes to using hearsay and selective conclusions as a basis for establishing epidemiological results.

Day 16 Hospital
The morning started off with a wonderful phone call from Melissa Herzog. Lauren had peed for the first time. This meant she did not have permanent renal damage. I was so happy for their family. It is a frightening thought to think that your child needs to remain on kidney dialysis for an indefinite period of time. The next stage, needing a kidney transplant is not something even imaginable and all because of a crazy bacteria.
Melissa was so encouraging. She said, If Lauren peed, this means Chris is going to pee! The progression of the kids symptoms had been nearly identical; hopefully this meant that Chris would soon be urinating. It had been 11 days since they were diagnosed with HUS. It took the Shiga toxins 10-14 days to leave the body. I felt a glimmer of hope.
There was a health food store a few blocks from the hospital. When I picked up some food for breakfast, I noticed all the raw milk had been removed from the shelves. I was surprised. Later, a friend of mine who lives in San Diego County called telling me there was an article in the newspaper (later she brought it to me) about Chris, Lauren (their names were not used) and two other children from San Diego who all became ill after drinking the same brand of raw milk. In this article, they stated that the blueprint of E.coli 0157:H7 found in the fecal samples of the kids that drank raw milk did not match the blueprint found in the spinach outbreak. In simple language, this means that these kids did not eat Dole packaged spinach that was implicated in the spinach outbreak. Something else they all ate or were exposed to made them ill and it was believed to be raw milk.
For those not familiar with the geography of California, imagine a line. At one end, next to the Mexican border, is San Diego County. Head north on this line about 80 to 100 miles and you will be in Riverside County. This is the county we live in. Continue heading north about another 50 miles and you will be in San Bernardino County where the Herzogs live. So at this time, the newspaper was reporting 4 children were ill: 2 from San Diego County, 1 from Riverside County and 1 from San Bernardino. (Note: the final count was 6 children)
By this time, they had traced the spinach outbreak to Dole packaged spinach and now there were 4 children, not just two, who also drank the same brand of raw milk. I had pinned my hopes on the spinach for causing Chris to become ill. He didnt eat Dole packaged spinach, so spinach was ruled out for a possibility for what made Chris ill. There was no doubt at the hospital what made the kids ill. HUS is rare and to have two children show up in the same timeframe developing HUS and both having consumed raw milk, well, it was a no brainer as to what made them ill. Now two more children were also ill and they drank the same raw milk. During this timeframe, someone from public health came to talk to us about what Chris ate. They asked a whole list of questions.
(Note: Even if a child does not develop HUS after being infected with an E.coli 0157:H7 infection, the child is quite ill for 7 to 10 days. Remember all the diarrhea and vomiting I described in the beginning? It is very painful and it takes the colon a long time to recover. Some children and adults even suffer long term health consequences about battling and E.coi infection. Those Shiga toxins are nasty.)
The day passed. Chris was still using the BiPap, he received dialysis, and the physical therapist came for the first time. He also developed a low grade fever. Late that evening, my sister and brother-in-law came to visit. I left them alone and went to the waiting room. About 15 minutes later, my brother-in-law came running to tell me that Chris had just peed. I couldnt believe it. I ran back to the room and when I saw Chris, I began sobbing; it was gut wrenching, releasing more than two weeks of severe stress and grief. Not only had Chris peed, he peed 500 ccs. It was a huge amount. Tony was asleep at the Ronald McDonald House. I ran across the street to tell him. It was a happy night. Just as Melissa had predicted, both Lauren and Chris peed on September 22nd.
September 22nd was also a special day for another reason. I have a very dear friend who lost her son in a car accident the year before. He had been killed by a drunk driver. He was only 19 years old. When Chris first became ill, Lisa prayed to Ryan and sent him to be with Chris and to keep him strong. September 22nd was Ryans birthday. It is quite the coincidence that Chris peed for the first time on Ryans birthday. I told Lisa it was Ryans way of telling her that he heard her message. We refer to Ryan as Chris special angel.
So September 22, 2006 is a day both the Martins and the raw milk farmers family will remember forever. Chris peed for the first time and their milk was pulled off the shelves. We didnt have the crystal ball to predict that our lives would become intertwined.

Wow. You came to visit on the day Chris peed. Very eerie.
(Note: Yesterday I discovered that the farmer had visited the hospital on September 22nd, not September 25th which had been reported in a magazine article in December of 2006. I didnt write down the day the farmer visited or the day the public health nurse picked up the food because I didnt view it as important. Chris was our focus.)
I try to imagine what it must have been like to be the farmer during this recall. This particular farmer is a warrior. He comes from a family of warriors. Warriors only know how to fight. This is their strength. Warriors go on the offensive. They are not passive. So it is not surprising that the farmer took an offensive position when he felt his dairy was being unduly attacked.
His first move was to visit our families in the hospital. Weeks before when Chris and Lauren had been diagnosed with HUS, both families had separately contacted the dairy to report their child was in the hospital. Since Melissa had not given Lauren the milk, the girlfriend of Laurens father was upset that CDFA had been contacted. She believed vehemently that the raw milk was not the cause of Laurens illness. She had been in contact with the farmer and without Melissas knowledge a visit was arraigned to meet Lauren. The 5700 and 5800 units were locked facilities. No one could gain access without parental consent. Laurens father gave consent for the visit.
After visiting Lauren, the farmer approached me. I dont know how he knew who I was. He found me sitting on the floor outside the 5700 unit talking on my cell phone. We had a friendly conversation and I shared Chris status and other details of his illness. I also told him a public health nurse had picked up the spinach and empty bottle of milk and that any day we should hear the results of the tests. I did tell him that I hoped his milk isnt what made Chris ill. I even hugged him because I could only imagine the tremendous stress he was under. Then Tony came around the corner. The tone changed quickly and I wasnt going to stick around for whatever Tony had to say to the farmer. It wasnt going to be nice. He was in high gear anger mode. His baby had suffered too much. The conversation was not pleasant.
I didnt make much of this surprise visit. It happened and I did not give it much thought as the days moved forward. More than half a year later I would learn what had transpired in the raw milk community after the farmer visited. True to form, this warrior had gone on the offensive. This was the day Chris and Laurens illness became political.
We were families dealing with our sick children. We didnt know there was a raw milk movement slowly occurring in the U.S. We had never heard of the Weston A. Price foundation, Sally Fallon, or Ted Beals. We didnt even know David Gumpert had this blog. ? Despite all this, people in the raw milk community learned who our children were.
Day 17 Hospital
The mood was lighter today because Chris had urinated. It was the first sign that his body was beginning to heal. He received dialysis, a blood transfusion, physical therapy and also had a low grade fever. When our friend from work arrived for a visit, Chris was still on the BiPap machine. After visiting for about an hour, I noticed our friend was not looking well. All of a sudden she began to faint. Thank goodness Tony was standing right next to her. I yelled for him to grab her. He caught her as she was falling off the chair. She felt quite embarrassed when she woke up. I remember reflecting how normal her response was. We had all grown numb to the horror of his condition.
The media frenzy began. Word got out that Chris and Lauren were at LLUCH. Reporters were leaving messages for us at the PICU front desk. Chris was still too sick. We didnt want to talk to reporters. Lauren was doing much better. Over the next couple of days, the T.V. stations covered the story and a picture of Lauren was shown. One of the nephrologists was interviewed.
During this timeframe, Melissa had Lauren walked over to our unit. Lauren was still hooked up to an I.V. bag, so they were rolling the pole along with them. Melissa wanted to give us hope that Chris too would get to this stage. I couldnt wait. Chris had been lying in a bed for 17 days. Melissa was always so encouraging. It was wonderful to have someone else who understood what we were emotionally going through.
In the early evening, they switched Chris from the BiPap machine to a regular oxygen mask. He was so angry once he could speak. He yelled at us, That was mean! referring to the BiPap mask. The reality of what Chris had been through hit us hard. It was easy to cope when he was sedated, but now that he was alert, it broke our hearts. He began to cry and said he wanted to go home. We tried to comfort him. It was frustrating because I couldnt hold him. He still had too many tubes and lines coming out of his body.
Another good sign occurred. Chris wanted to watch T.V. Later that evening he peed for the 2nd time. It was another large amount.
